Given the evidence including a police report of lost identity card, expert opinion that signatures were probably not genuine, the bilateral nature of the documents with no subsequent Land Registry transactions affecting third parties, and the need to prevent detriment to the deceased's estate, the court exercised its discretion to grant declaratory relief by consent, held the loan and mortgage documents were not executed by Mr Lai and were not binding on him or his estate, dismissed the defendant's counterclaim and ordered the Land Registry registration vacated.
