Although the court found assaults and related improper acts occurred and were connected to the debt allegedly owed to the 1st defendant, those acts were committed outside the express and implied authority of the appointed debt collector (and any sub-agents), the appointment had been terminated by the end of January 2000 (confirmed 12 February 2000), there was no evidence defendants authorized, instigated or ratified the torts and therefore the defendants were not liable.
