Because the magistrate imposed a substantial fine without any inquiry into the appellant's means making the alternative imprisonment illusory and the default penalty could be meaningless if concurrent, and because the offence involved a minuscule quantity and a first trafficking offence placing it at the lower end of the tariff, the fine was set aside and the custodial term reduced from 2 years to 18 months.
