Because partition was impracticable and uneconomic, the 1st Defendant had defaulted on agreed monthly payments and excluded the Plaintiff from occupation and was unable to remedy arrears or give realistic undertakings, the court exercised its power under section 6 of the Partition Ordinance to order sale so that the Plaintiff may realise her interest; specific performance was inappropriate given defendant's breaches and unemployment.
