Scarlet's persistent failure to render full and proper accounts and imposing a condition on distribution was prejudicial to the residuary beneficiary and justified her removal; accordingly the costs order nisi that Scarlet personally pay Camey's costs is made absolute; Scarlet is nonetheless entitled to the usual indemnity out of the estate for her own costs under Order 62 r6(2) because she did not act unreasonably in defending the action and the application to deprive her of indemnity was not made in time; the appeal is not reasonably arguable so a stay of execution is refused.
