The appeal is dismissed because the applicants failed to show the Investigation Committee lacked independence or impartiality or that the Council's correspondence constituted an unlawful exercise of statutory power; the Council had not made a s42C(1) referral when proceedings began, the challenged letters were not reviewable decisions in the required statutory sense and the judicial review application was premature.
