Section 36(c) requires proof that the officer was engaged in a lawful apprehension or detention; where statutory power to arrest depends on written authorisation (s.84 PHMSO), the Crown must prove such authorisation; absence of proof of the officer's lawful authority means an essential ingredient of s.36(c) is not established and the conviction must be quashed.
