The Court upheld the trial judge's credibility and factual findings, found the plaintiff failed to discharge the burden of proof that the four PRC properties and the contested documents belonged to the deceased and were wrongfully taken, ruled the proposed fresh evidence did not satisfy the Ladd v Marshall tests, and therefore dismissed the appeal and ordered costs against the plaintiff.
