Because the defendant accepted the goods in the ordinary course, acted properly and fairly, and the plaintiff's injunction and choice to sue the defendant caused charges to accrue, it is just under Order 17 r.8 R.S.C. and established practice that the defendant's taxed costs and handling/storage charges be a first charge on the goods; the plaintiff is indemnified by the claimant for those costs and charges incurred between 8 January 1992 and 7 June 1993; plaintiff's legal aid costs to be taxed under Legal Aid Regulations.
