Applying the two-stage Moulin approach and O.24 r13 the court held production was necessary but must be ordered subject to limited interim safeguards to preserve fairness pending the s740 substantive hearing; production without safeguards would permit the Plaintiff to circumvent the s740 process and risk collateral disclosure given the Plaintiff's conduct; accordingly production was ordered subject to the Presentations Confidentiality Undertaking and costs were ordered nisi for the Defendant with certificate for two counsel.
