No separate offence called 'conspiracy to effect a public mischief' is required; the particulars and proved overt acts disclosed an unlawful conspiracy maliciously to injure the ballroom business and malice could be inferred from the concerted conduct, therefore the convictions were properly upheld despite the label 'public mischief' being surplusage.
