The Court dismissed the Notice of Motion and granted the discontinuance; it held there were no exceptional circumstances to depart from the general principle that the discontinuing party should pay costs because the Registrar had directed the motion proceed inter partes on 30 July 2020 and the Director had been involved; the applicant was ordered to pay the Director's costs of the Notice of Motion to be summarily assessed on paper and to file comments on the Director's statement of costs within seven days.
