The Court held that the Authority's public statements and materials did not demonstrate apparent bias or predetermination because expressing provisional views in the context of a statutory consultation and regulatory role is permissible, the Authority had made express and credible assurances of an open mind supported by past practice of changing positions, and the challenge was premature insofar as it attacked an interlocutory procedural decision to proceed with the consultation; accordingly PCCW's judicial review was dismissed.
