Application dismissed because the Director failed to satisfy stage one: there was insufficient evidence that adoption (particularly an apparent Convention adoption) is in the child’s best interests. The court gave significant weight to the child’s consistent expressed wish to remain with the foster family, found the Director’s evidence and Adoption Checklist analysis inadequate and the permanency risks speculative; accordingly it was premature to consider dispensing the father’s consent under stage two.
