The Second Mortgage’s definition of "Obligations" encompassed the later Loan; the plaintiff complied with statutory requirements of the Money Lenders Ordinance and Orders 83A and 88; defendants were properly served but did not oppose; accordingly a money judgment is entered against the 1st defendant, possession and an order for sale of the Property are granted under the mortgage and Partition Ordinance, sale proceeds will pay the first mortgage in priority and then be split equally with the 1st defendant’s indebtedness and indemnity costs (HK$51,560) deducted from his half.
