The Court found nothing 'unjust' to prevent application of O 22 r 23; accordingly interest on the judgment from 24 March 2016 was disallowed, costs from that date were awarded to Defendant on an indemnity basis and Plaintiff was ordered to pay interest on those costs at 4.5% p.a. from 24 March 2016; additionally Plaintiff was ordered to pay Defendant's costs of preparing, filing and serving the Defence on a party-to-party basis and costs of the costs application to Defendant party-to-party.
