The judge found the husband had not shown a reasonable prospect of success on any of the five grounds (including errors alleged on third‑party assistance, husband's capital, wife's means and quantum of LCP) and there was no other reason in the interests of justice to grant leave; accordingly leave to appeal was refused and the summons dismissed.

Applying a broad‑brush assessment of needs and means, the court found the wife had limited earning capacity and the husband was in a materially stronger position (including likely access to paternal support and significant assets held or purportedly held on trust); accordingly the husband’s undertaking of HK$22,500 was insufficient and must be increased by specific monthly orders: MPS HK$12,808.36 and interim maintenance for two children HK$31,780, with school fees and insurance to be paid direct; costs ordered nisi to husband.

The court declined to increase the husband's interim outgoings beyond his undertaking and existing voluntary payments, dismissed the wife's original amended summons, but directed release of HK$390,000 (equivalent to USD50,000) from the Villa P sale proceeds as maintenance pending suit (HK$8,125 pm for the wife and HK$8,125 pm per child for three children) for a 12‑month period backdated to January–December 2020, and made an order nisi that there be no order as to costs to be made absolute in 14 days.

Applying a broad-brush assessment of reasonable needs and the wife’s ability to pay, reducing the husband’s claimed amounts to reasonable figures, and recognising potential rectification at final ancillary relief, the court ordered the wife to pay the husband maintenance pending suit of HK$4,800 per month from 1 August 2014 and to advance HK$1,000 within 7 days for a plumber; cost consequences reserved.

The court continued inter partes the previously agreed restraints on dealing with shareholdings and the personal time deposit (paras 5 and 6 of the 16 Sept order) pending further order, required the husband to produce documentary evidence within 28 days accounting for the HK$940,000 transfer, declined to award interim maintenance for the children pending clarification of the funds, and ordered maintenance pending suit for the wife of HK$4,800 per month; costs: no order as to costs save petitioner’s own costs to be taxed under Legal Aid Regulations (order nisi absolute in 14 days).
