The Court refused leave to appeal because the proposed questions were fact-sensitive and did not raise issues of law of great general or public importance suitable for the Court of Final Appeal; consequently there was no basis to grant a stay or to admit new evidence. The appointment of provisional liquidators rendered the stay application academic. The interlocutory applications (Motion, Stay Summons, Evidence Summons) were dismissed and costs assessed against the plaintiffs.
