Stone J did not err in declining to construe the Determinations at interlocutory stage because the legal issues were interwoven with disputed facts and documentary incompleteness; the Court of Appeal, applying the Hadmor standard, held there was no basis to overturn his discretionary case management decision and likewise refused to disturb his grant of leave to amend the Statement of Claim.
