Leave to apply for judicial review was refused because the Applicant failed to identify any reasonably arguable public law ground with a realistic prospect of success: (1) there was no failure to consult the LAB because the SLS was amended to the ESLS preserving LAB involvement and extensive stakeholder consultations occurred; (2) there was no arguable breach of ILC No.144 because its tripartite consultation obligations were observed through the LAB/CIILS and it does not require consultation on every labour matter; and (3) while the applicant had sufficient standing, the merits were absent.
