A Justice of Appeal is a "public officer" within the IGCO s.3 definition, but the context, object and nature of the Town Planning Ordinance indicate a contrary intention displacing that definition for s.17A(2): judges' independence and suitability for quasi‑judicial roles show they were not intended to be excluded from the Appeal Board panel; accordingly Mr Justice Litton was not disqualified and the judicial review application is refused.
