The court held the notice to quit served under the repealed Security of Tenure Ordinance was ineffective to terminate the tenancy because the Rent Increases (Domestic Premises) Control Ordinance applied to tenancies existing at its commencement and manifested a contrary intention by prescribing an exclusive statutory termination procedure and transitional regime; accordingly s.23 of the Interpretation Ordinance did not preserve the old notice in this case.
