The High Court quashed the Immigration Tribunal's decision and remitted the matter to the Immigration Tribunal to determine first whether the power to grant permission to stay was delegated to Immigration Officers under s.43 of the Interpretation and General Clauses Ordinance; if delegation is found, the Tribunal must then determine whether the Immigration Officer in question granted permission; limited cross-examination of deponents was permitted but further evidence by the applicant was not allowed at this stage; costs reserved.
