Clause 4 of the DMC governs periodic monthly management fees only; the 1st and 2nd Projects are non‑recurrent special works falling within the special fund regime implied by s.34E and the Seventh Schedule to the Building Management Ordinance, and contributions for those projects were validly fixed by owners' resolution and properly apportioned by undivided shares in land; therefore the applicant succeeds and the respondent was not overcharged.
