Appeal dismissed: primary declaration upheld that Commissioner was wrong to refuse to consider the applications under reg.17(2) but appellant was not the 'owner' within reg.4 at the time the applications were before the Commissioner (property had not passed because of the contract clause), therefore Commissioner was not obliged to register and license the twenty vehicles; reg.17F does not require the Commissioner to state hypothetical merits he had not considered; s.4A(6) precludes compulsory registration now, so equitable conversion to taxi licences could not be ordered on the facts.
