The Court of Appeal held the Governor's appointment power in Article XIV is delegable in practice; s.63 Cap.1 permits delegation of the statutory appointment power in s.5 Cap.227; the 1974 minute constituted an effective delegation to the Chief Justice and was not rendered unlawful or revoked by the Judicial Service Commission Ordinance (s.15 preserves the Governor's power); the delegation was not Wednesbury unreasonable; accordingly Mr. Line's appointment was valid and Kaplan J.'s orders and declaration were set aside.
