On the admissible evidence the magistrate was entitled to find the hole was uncovered when the work commenced and to convict the appellant; the magistrate correctly excluded hearsay evidence about subsequent relocation of the cover; however the fine of HK$100,000 was excessive in all the circumstances and was reduced to HK$25,000.
