Where the statutory presumption in s.46 did not in fact arise because the mixtures lacked the drugs specified in the subsection, convictions for possession for the purpose of trafficking were unsustainable; the court must substitute convictions for simple possession and reduce sentences accordingly; the smoking conviction in Criminal Appeal 406 of 1971 was rightly upheld.
