The judge concluded that Order 58 must be interpreted to follow the established English practice and did not create a novel concurrent right of appeal to either a judge in chambers or the Court of Appeal; accordingly the judge in chambers lacked jurisdiction to entertain the appeal, the appeal was incompetent and had to be dismissed, and costs were properly awarded to the 17th Claimant under the court's discretion in Order 62.
