The court held that defendants' bare assertions of non-possession or possible destruction were insufficient under O 24 r 7 because deponents failed to state what searches or enquiries they made; accordingly the court ordered defendants within specified time to file affidavits stating whether documents in items 1,3(a)&(c),4-6 existed or had been in their possession, when they parted with them and what became of them, and to produce items 7-8 was refused as premature because enquiry into accounts is contingent on a finding of liability.
