TAI's s219 application was dismissed because it lacked standing: it is not a contributory (not on the register) and it is not a creditor for the purposes of s219 because it cannot presently lodge an admissible proof in TAL's liquidation due to the rule against double proof and express negative covenants in the guarantees and share charge preventing it from proving in competition with BOC; BOC was entitled to intervene; the Yuens, though contributories, were denied a s219 inspection as their purpose was limited and not for the benefit of the liquidation.
