The Deed's Clause 9 required distribution of the net residuary estate defined as the cash equivalent of the entire realized estate after necessary expenses; the Consent Order incorporated the Alleged Gift into the estate for distribution purposes; accordingly the plaintiff is entitled to 40% under the Deed and defendants' claims that the Alleged Gift was excluded or that the plaintiff was overpaid were rejected; counterclaims dismissed and equitable relief (injunctions and specific performance) granted to enforce the 60/40 distribution; costs to plaintiff.
