Appeal allowed because the trial judge's handling of witness credibility and his approach to evaluating the evidence (including wholesale rejection of PW3 and an ambiguous stance that effectively required the defence to disprove witnesses he professed to believe) rendered the conviction unsafe; therefore conviction quashed and sentence stayed.

The Court upheld the trial judge's discretionary refusal to allow a last‑minute amendment to plead intoxication because the amendment would have caused substantial prejudice to the plaintiffs, required a probable adjournment given the delay of over three years, and undermined efficient case management; absent a satisfactory explanation for the delay the judge did not err in exercising his discretion to refuse.

The conviction is upheld because the magistrate's acceptance of the complainant's account and rejection of the appellant's intoxication and accident defence was supported by the totality of the evidence, and neither the character evidence nor the asserted drunkenness created a reasonable doubt.

On the balance of probabilities the deceased was an employee of the respondent (promised monthly wage $13,000); the accident arose out of and in the course of employment under s5(4)(a),(b); there was no pleaded or admissible evidence that intoxication caused the accident; accordingly the respondent was liable under the Employees Compensation Ordinance and judgment was entered for the applicant for statutory compensation and funeral expenses totalling $800,000, with interest and costs as ordered.
