On the balance of probabilities the plaintiff did not first introduce the eventual purchaser or provide services that were the effective cause of the sale; YK acted independently and not as the plaintiff's agent, and the contract required the introducer to have effected the introduction to the purchase—therefore the plaintiff is not entitled to commission and the claim is dismissed.
