On the facts the defendant did not assume a relevant contractual or tortious responsibility to the plaintiff: there was no contract between plaintiff and defendant, the relationship was mediated and shaped by the private banker (Ms Zau) who set up the account and had primary advisory role, and the circumstances did not establish the defendant had assumed responsibility such that a duty of care arose; accordingly the plaintiff's claim is dismissed.
