The court was not satisfied on the evidence that the alleged loan was made on or about 25 July 1983; accordingly the court ordered an issue to be tried as to the truth of the facts and matters alleged by the plaintiff in his Statement of Claim and affirmation, with Lee and Kao as plaintiffs and the applicants as defendants, and made that order conditional upon the applicants filing an undertaking in damages within 14 days and fortifying it to US$50,000 within a further 28 days, with mutual discovery by affirmation within 28 days.
