On the balance of probabilities the court found the contract was entered into between the plaintiff and the 1st defendants (Eiko Shoji); there was insufficient evidence of a personal contract with the 3rd defendant so his claim was dismissed; the 2nd defendant (DCL) was not treated as the contracting party for purposes of final judgment because evidence showed DCL was effectively a straw company and the plaintiff was entitled to determine the true liable party.
