Applying the indicia of employment and the authorities, the court found on the unchallenged evidence that the deceased was an employee of the 1st respondent at the time of the accident, that the accident arose out of and in the course of employment, and that the 1st respondent was liable. The court accepted the agreed quantum (monthly earnings HKD 20,000; 8% loss of earning capacity; multiplier 48; 187 days sick leave; medical expenses HKD 6,070) and awarded HKD 181,237.12 with interest and a costs order nisi.
