The Mareva injunction was discharged because the plaintiff failed to establish a good arguable case on both liability and quantum for recovery of the sums claimed, failed to present cogent evidence of a real risk of dissipation, the monies in the account were shown to belong to the defendant and the joint control expired on 12 November 2020, and the ex parte materials did not adequately identify the cause of action or quantify the claim; accordingly the injunction and ancillary disclosure order were refused.
