Because s.160(1) makes the failure to give a satisfactory account/explanation an ingredient of the loitering offence and that account/explanation is to be given to the police officer when afforded the opportunity, persons cannot generally be jointly charged with loitering; joint charging is permissible only in limited circumstances where the failures are effectively joint (for example where one counsels or procures another to refuse to answer).
