The application was dismissed because the Court of Appeal has decided that the Building Authority has power to require proof of ownership or realistic prospect of control and to reject building plans where such proof is lacking; those decisions are binding on this court. Accordingly REDA's ultra vires challenge failed; the BA's power to require such proof and to reject plans is lawful, subject to ordinary public law limits and the statutory appeal mechanism.
