The court refused the applicant's request to withdraw but, on merits and in the exercise of its discretion, dismissed the leave application: the Board acted within the statutory framework of s37ZT(2) in refusing late filing based on insufficient explanation and lack of due diligence; the applicant's grounds were general and lacking particulars; and the claim had become otiose because the applicant withdrew and confirmed it was safe to return to India, so any remedial order would serve no practical purpose.
