The application was dismissed because the applicant failed to establish the jurisdictional prerequisite of a 'substantial connection' with Hong Kong under section 6(2)(c): the Minor's travel record (18 visits over two years, mostly 2-3 day stays and one 11-day stay) showed transitory presence insufficient to constitute a substantial connection, and therefore the court could not entertain the section 6 declaration notwithstanding conclusive DNA proof of paternity.
