- Court of Appeal
- Case number
- CACV671/2001
The Court held that the existence of a judgment against the debtor and the several liability of sureties meant that the creditor's enforcement of one guarantor without pursuing co-sureties or other security did not of itself make the bankruptcy order inequitable; accordingly the appeal was dismissed and the bankruptcy order was affirmed.
