The court had jurisdiction under Order 58 r 1 to rehear the Master's reconsideration and, applying its discretion, allowed the appeal and set aside the part of the 12 October 2005 order that prevented Deacons from prosecuting for payment because Deacons had an enforceable contractual right under the 7 March agreement and no sufficient reason existed to deny enforcement.
