The appeals court held that the jurisdictional ground and the quantum ground are conceptually separate; defendants succeeded on quantum (reducing damages to HK$7,349,040) but failed on the jurisdictional argument and were the losing party at trial, so the Recorder's costs order below is not disturbed; on the appeal justice requires plaintiffs to pay one third of defendants' costs of the appeal, taxed if not agreed; costs of stay applications and costs of written submissions on costs are to be treated as part of the appeal costs.
