The Court held that SFO s213 read with s274 expressly contemplates proceedings and relief against persons "in Hong Kong or elsewhere"; therefore the writ falls within Order 11 r1(2) and service out of the jurisdiction was permissible without leave. Consequently the appeal was dismissed.
