The principal substantive issue was Question 1 (discharge of the restraint order after refusal to grant a confiscation order); Question 2 was a secondary procedural matter. Therefore strict issue-based apportionment was rejected; a modest deduction was justified because the SJ was not wholly successful. The order was varied so Tam pays 80% of the costs of FACV 12/2022 plus costs of the proceedings below, to be taxed if not agreed; no order as to costs in FACC 4/2022, FACC 1/2023 and FACV 2/2023.
