The judge held that where the settlement/likely recovery falls within the exclusive jurisdiction of the SCT, the District Court may exercise its wide costs discretion to assess costs as if the action had been commenced in the SCT, which excludes recovery of legal fees; the master's refusal to give effect to the parties' agreed Costs Term was overturned and the consent settlement should be implemented with costs summarily assessed at HK$500.
