Where the aggregate of appropriate sentences reaches the magistrate's jurisdictional maximum the court must nevertheless reflect credit for a guilty plea by imposing a total sentence less than that maximum; accordingly the magistrate's order making both 18‑month sentences wholly consecutive was quashed and substituted so that only 12 months of one sentence is consecutive, producing a total of 30 months imprisonment.

The court held that although the robbery warranted a higher starting point (at least three years), the magistrate was constrained by a two year jurisdictional limit and guilty plea credit must be calculated from that limit; the appellate court substituted an 18 month sentence for the robbery count and structured partial concurrency/consecutivity (9 months consecutive, 6 months concurrent of the 15 month immigration term, and the 1 month theft term consecutive) to maintain a proper totality of 28 months; appeal dismissed.

Where a sentencing judge in the District Court concludes the proper sentence exceeds the court's statutory jurisdiction, any discount for a guilty plea must be applied against the maximum sentence the District Court can impose; applying that principle reduced the imposed seven year term to six years to reflect the guilty plea.

The Court held the trial judge was entitled to infer from the facts that the defendant used a ruse to remove the victim from her father's control and that although a sentence of 18 months would have been appropriate after trial, the plea of guilty warranted credit; accordingly the appeal was allowed to reduce the sentence from 12 months to 6 months imprisonment.
